Acceptable Use Policy (AUP)
1. Acceptable Use
By using the products and/or services of Edgecast, Inc. (“Edgecast”), you agree to abide by the provisions of this Acceptable Use Policy (“AUP”). Edgecast reserves the right to modify this AUP at any time, and such modifications become effective upon posting. Continued use of Edgecast’s products and/or services constitutes acceptance of the AUP, as modified.
2. Illegal Use
Edgecast’s products and services (“Services”) may only be used for lawful purposes. The transmission, distribution, or storage of any material in violation of applicable laws or regulations is prohibited. This includes, but is not limited to:
- Material protected by copyright, trademark, trade secret, or other intellectual property rights used without proper authorization.
- Material that is obscene, defamatory, or constitutes an illegal threat.
- Material that violates export control laws.
3. System and Network Security
Violations of system or network security are prohibited and may result in criminal and civil liability, in addition to suspension or termination of Services. Edgecast will investigate suspected violations and may cooperate with law enforcement where a criminal violation is suspected.
Prohibited Activities Include (but are not limited to):
- Unauthorized access to data, systems, or networks, including attempts to probe, scan, or test vulnerabilities or breach security/authentication measures without explicit authorization.
- Unauthorized monitoring of data or traffic on any system or network without explicit authorization.
- Interference with service to any user, host, or network, including:
- Mailbombing
- Flooding
- Deliberate overloading of a system
- Broadcast attacks
- Forging of TCP/IP headers or email/newsgroup headers.
- Users may not use Edgecast services to create, transmit, distribute, or store content that:
- Violates any applicable laws, including but not limited to intellectual property infringement, unauthorized use of proprietary information, child exploitation, money laundering, terrorist financing, export control violations, and fraudulent activities.
- Promotes hate speech, violence, discrimination, terrorism, or self-harm.
- Includes malware, phishing schemes, unauthorized access to systems, or activities that compromise data integrity.
- Engages in denial-of-service (DoS) attacks, excessive API requests, or any actions that interfere with network performance.
- Sends unsolicited bulk messages, engages in phishing, or uses misleading email headers.
- Violates data privacy regulations such as GDPR, CCPA, HIPAA, or other local, national, or international laws regarding personal data collection, use, or storage.
- Uses generative AI, bots, or automation tools to spread misinformation, manipulate public discourse, impersonate individuals or organizations, or deceive users.
- Misrepresents the origin of content, falsifies user identity, or impersonates others without authorization.
4. Usenet
Posting the same or similar message to one or more newsgroups (excessive cross-posting or multiple-posting, aka "SPAM") is explicitly prohibited.
5. Email
Sending unsolicited email messages (SPAM) is explicitly prohibited. This includes, but is not limited to:
- Commercial advertising
- Informational announcements
A user must not:
- Use another site’s mail server or system to relay mail without express permission.
- Send any email or content that:
- Uses an Edgecast account as a mailbox for responses.
- Promotes content hosted or transmitted using Edgecast’s facilities.
- Indicates in any way that Edgecast was involved in the transmission.
This AUP applies to all emails and content transmitted using Edgecast Services, accounts, mailboxes, or facilities.
6. Copyright / DMCA
Edgecast respects the intellectual property rights of customers, end users, and third parties. Without limiting its rights, Edgecast:
- Complies with all aspects of the Digital Millennium Copyright Act (DMCA) (42 USC 512).
- Maintains and enforces a policy to terminate services for any end user found guilty of repeat copyright infringement.

7. Enforcement Actions
Edgecast reserves the right to enforce this Acceptable Use Policy (AUP) through the following means:
- Immediate suspension or termination of Services with or without notice.
- Issuing warnings or allowing correction of violations, if practical.
- Upon receiving reports of violations, Edgecast may conduct an internal review, which may include logging user activity and suspending access to certain services.
- Users may be required to remove offending content, take corrective measures, or confirm compliance with the AUP before service restoration.
- If required by law, Edgecast may disclose user data to regulatory authorities or take legal action against violators.
- Severe or repeated violations may result in immediate suspension or permanent termination of services without prior notice.
- Edgecast may use automated detection systems, manual review processes, or third-party intelligence sources to identify and address violations, in accordance with applicable privacy laws.
- Users may request a review of enforcement actions within seven (7) calendar days of notification. Edgecast is not obligated to reinstate services but will review all reasonable appeals submitted in good faith.
While Edgecast may, at its discretion, provide advance notice or allow corrective action, it is not required to do so and is not liable for any failure to provide such notice.
8. Reporting Violations
For Illegal Use or System and Network Security issues (excluding copyright complaints):

Reports should include:
- A description of the violation
- Relevant URLs, logs, or screenshots (if applicable)
- The reporting party’s contact details (optional)
- Reports may be submitted anonymously; however, providing contact details may assist in investigation or follow-up.
9. User Obligations
By using Edgecast services, users agree to:
- Ensure that all content and activities adhere to local, national, and international laws.
- Promptly respond to Edgecast inquiries regarding suspected violations.
- Comply with all applicable regulatory obligations, including those related to content moderation, data retention, data protection, and the lawful use of encryption technologies.
- Refrain from exporting or re-exporting Edgecast services in violation of any applicable export control or trade laws.
- If a customer provides Edgecast services to others (e.g., resellers, partners), they are responsible for ensuring their users comply with this AUP.
- This includes implementing appropriate controls, monitoring downstream usage, and enforcing corrective actions where necessary.
10. Changes to this Policy
Edgecast reserves the right to update this Acceptable Use Policy as needed. Any significant changes will be communicated via email or a notice on our website at least 30 days before taking effect.
- Continued use of the services after the effective date constitutes acceptance of the revised policy.
- In situations requiring urgent security or legal compliance updates, Edgecast may modify this policy immediately. When possible, users will be notified promptly following such changes.
11. Disclaimer of Liability
Edgecast is not liable for any user-generated content or activities conducted through its services. Users are solely responsible for their actions and content, and agree to indemnify and hold Edgecast harmless from any claims, damages, or losses arising from violations of this policy.
